What Tenants Need to Know About the Tenancy Tribunal
The Tenancy Tribunal is an independent body that helps resolve disputes between tenants and landlords. If issues arise during your tenancy that can't be resolved through communication, the tribunal can step in to make legally binding decisions. Here's what you need to know as a tenant.
How the Tenancy Tribunal Helps Tenants
If you’re facing serious issues in your rental, like urgent repairs being ignored, unsafe living conditions, or unresolved breaches of the tenancy agreement, you have the right to apply to the Tenancy Tribunal. The tribunal can require the landlord to carry out repairs, address breaches, or even compensate you in some cases.
The tribunal also hears cases brought by landlords, such as those involving unpaid rent or property damage. In all cases, the tribunal remains neutral and makes decisions based on the evidence presented.
Getting Ready for a Tribunal Hearing
If you apply to the tribunal, or your landlord does, you’ll be sent a notice with the hearing date and time. It's important to be prepared and gather any evidence that supports your case. This may include:
- A copy of your tenancy agreement
- A written summary of what’s happened
- Photos of the issue (e.g. damage, mould, leaks)
- Copies of any communication with your landlord or property manager (emails, texts, letters)
- Repair requests or maintenance reports
- Witness statements or statutory declarations (if applicable)
You can represent yourself, or have a support person or advocate attend the hearing with you.
What to Expect at the Hearing
At the hearing, a tribunal adjudicator will first see if both sides can agree to conciliation. If not, the matter will proceed to a formal hearing. You’ll have the opportunity to explain your side and present evidence, and the landlord will be given the chance to respond.
Once the adjudicator has heard both sides, they will make a decision and issue a notice of orders. This document outlines what each party must do, such as fixing a repair within a set timeframe or paying compensation.
Why the Tenancy Tribunal Matters
The Tenancy Tribunal offers a fair and formal process for resolving rental issues that can’t be settled privately. While many problems can be sorted through your property manager or by talking directly with your landlord, the tribunal exists to ensure tenants’ rights are upheld when that doesn’t happen.
If you’re unsure about whether a situation calls for tribunal involvement, your property manager or a tenant advocacy service can help you understand your options.
